Your use of the Peters app (including the content and any other services provided by us at any time) is subject to the following Terms of Use, which you are deemed to accept by downloading/accessing the Peters app.

The copyright and all other rights in the material in the Peters app are owned by ICL Specialty Fertilizers or are included with the permission of the owner to the rights thereof.

Suspension of the Peters App
ICL Specialty Fertilizers BV reserves the right to: (a.) deny or suspend your access to the Peters app with or without notice to you if your use of the Peters app is deemed by us to be abusive, excessive, or against the interests of other users of the Peters app or in breach of these Terms of Use, all to be determined at ICL Specialty Fertilizers’ sole discretion; and (b.) to remove any content or material uploaded to www.icl-sf.com by you with or without notice. Additionally, we reserve the right to suspend, restrict, or terminate access to the Peters app for any reason, to anyone at any time.

Limit of liability
We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence: all liability for any claims, losses, demands, and damages arising directly or indirectly out of, or in any way connected with (the use of) the Peters app and/or any products/services offered via the Peters app from time to time.

This exclusion shall apply in every respect without limitation, any interruption of service, lost profits, loss of contracts or business opportunity, loss of data, or any other consequential, incidental, special, or punitive damages, arising out of the Peters app even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise.

Your obligations to us

To the extent to which your use or the use by any person who may be authorized by you or, for whom you are responsible (for example, as an employer) causes loss or damage to us or any person, you agree to compensate us immediately on demand, in relation to any such losses or damages attributable to us, including where necessary any legal, administrative or technical charges that should arise from such usage.

General
ICL Specialty Fertilizers may at any time revise these Terms of Use by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then-current Terms of Use to which you are bound.

If any of these Terms and Conditions should be determined to be illegal, invalid or unenforceable for any reason by laws in any state or country in which they are intended to be effective, then to the extent that such Term or Condition is illegal, invalid, or unenforceable, it shall be severed and deleted and the remaining Terms and Conditions shall remain in full force and continue to be binding and enforceable.

Governing law
These Terms of Use are exclusively governed by and construed in accordance with Dutch law. Any dispute arising from these Terms of Use shall be referred to the Amsterdam District Court.
